HALO HALO Community Policy and Uploading Guildelines

This Halo Halo Community Policy and Uploading Guidelines (“Guidelines”) forms part of our Terms of Use and outlines the rules and guidelines for creators using the HALO HALO App platform or the halohaloapp.com Website to publish their content. By submitting your content to HALO HALO and you agree to comply with these Guidelines.
1. Acceptance of the Guidelines
By submitting (“Submissions”) your content and posting your content ("User Postings") to HALO HALO, you acknowledge that you have read, understood, and agreed to these Guidelines, as
well as our Terms of Use and Privacy Policy. If you do not agree or comply with these terms,
you may not use, submit, comment or upload onto the HALO HALO App or halohaloapp.com
(“Services”).
2. Content Ownership Licensing
● Ownership: You retain all IP ownership of the rights to your Submissions and User Postings including any associated copyrights, trademarks, and/or patents that you may hold.
● By submitting your content to HALO HALO, you grant us non-exclusive, irrevocable, royalty-free, worldwide license to use, post, reproduce, reformat, modify, publish, and distribute your Submissions and User Postings on the HALO HALO App and HALO HALO websites. This license will be valid up to 60 days after your written request that a Submission or User Posting be removed.
● However, for all Submissions and User Postings, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, post, reproduce, modify, publish, and distribute your Submissions and User Postings for the purpose of creating and distributing promotional materials to promote the Services including promotional
materials or surveys for any online contests.
● License Limitations: The license granted to HALO HALO includes the right to create derivative works solely for marketing and promotional purposes related to your content and the Services.
● For online contests, you grant us a license to feature your Submission on the our platform (website and mobile) and across all our social media channels (Facebook, Instagram, TikTok, X, etc.) as well as allow us to use your name and likeness for promotional purposes related to the online contest.
3. Content Guidelines
To maintain a safe and enjoyable environment for all users, your Submissions and User Postings must adhere to the following guidelines:
● Originality: All submitted or uploaded content must be your original work. You may not upload content that infringes on the intellectual property rights of others or you must have sufficient ownership or other intellectual property rights required to upload the User Postings consistent with these terms.
● Appropriateness: User Postings must not contain any offensive, abusive, or illegal content. This includes hate speech, harassment, and explicit material.
● Violent or Graphic Content. We do not allow graphic depictions of gratuitous violence or content that promotes acts of violence.
● Dangerous or Illegal Content. Content that is encouraging, promoting, or soliciting dangerous or illegal activity is not allowed.
● Compliance with Laws: You are responsible for ensuring that your User Postings comply with all applicable laws and regulations.
4. Submissions and Waiver
• You acknowledge and agree that each Submission will be made voluntarily and not in confidence. That means that neither your Submission nor anything in these Terms shall or may be deemed to place HALO HALO in any relationship (including any confidential relationship) with you that is different from that of the general public with respect to the
Submission.
• With respect to any characters, art work, music, scripts, screenplays, storylines, and/or plot outlines (referenced herein collectively or separately as “Entertainment Materials”), you hereby waive any claim, action, and/or suit (collectively, “Claims”) against HALO HALO, and/or HALO HALO’s affiliates, distributors, customers, vendors, promotional partners, and/or licensees, and/or their respective officers, directors, employees, agents, and/or assigns, relating to any alleged use or misappropriation by HALO HALO of any Submission or User Posting.
5. Content Moderation
HALO HALO reserves the right to review, monitor, and moderate User Postings to ensure compliance with these Guidelines. We may remove any content that violates these Guidelines or that we deem inappropriate at our discretion. You agree that you will not post, send, submit, publish, upload or transmit any material that:
• You do not have the right to post, including proprietary material of any third party, such as files containing software or other material protected by intellectual property laws (or by rights of privacy or publicity);
• Advocates illegal activity or discusses an intent to commit an illegal act;
• Is vulgar, obscene, pornographic, or indecent;
• Threatens or abuses others, libels, defames, invades privacy, stalks, is obscene, pornographic, racist, abusive, harassing, threatening, or offensive;
• Seeks to exploit or harm children by exposing them to inappropriate content, asking for personally identifiable details or otherwise;
• Harvests or otherwise collects information about others, including e-mail addresses, without their consent;
• Falsifies or deletes any author attributions, legal or other proper notices, or proprietary designations or labels of the origin or source of software or other material contained in a file that is permissibly uploaded;
• Advertises any commercial endeavour or otherwise engages in any commercial activity except as may be specifically authorized by HALO HALO
• Includes programs that contain viruses, worms, and/or Trojan horses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications;
• Contains hyperlinks to other Sites that contain content that falls within the descriptions set forth above.
6. Reporting Violations
If you encounter any User Postings that you believe violate these Guidelines please report them to us through the appropriate channels provided in the Terms of Use.
7. Termination of Access
We reserve the right to suspend or terminate your access to the Services if you violate these Guidelines or any other terms outlined in our Terms of Use.
8. Changes to the Guidelines
HALO HALO may update these Guidelines from time to time. We will notify you of any significant changes by posting the updated policy on the halohaloapp.com website and/or App. Your continued use of the Services after any changes indicates your acceptance of the new policy.
